The agreement
Canary9 is an uptime and synthetic monitoring service operated by Canary Monitoring, Inc. ("we", "us"). These terms are a binding agreement between you and Canary Monitoring, Inc. If you use Canary9 on behalf of a company, you confirm that you are authorized to accept these terms for it, and "you" means that company.
Your account
You must provide accurate registration information and keep it current. You are responsible for activity under your account and for keeping your credentials confidential. We strongly recommend enabling two-factor authentication. Tell us at support@canary9.com if you believe your account has been compromised.
Acceptable use
Canary9 sends real network traffic to the targets you configure. You may only monitor endpoints that you own or that you have permission to monitor. You agree not to:
- Use the service to probe, scan, or load-test systems without authorization.
- Attempt to disrupt the service, other customers, or the probe network.
- Circumvent plan limits, metering, or access controls.
- Use the service for any unlawful purpose.
We may suspend monitoring of a target, or an account, that we reasonably believe is being used against these rules. Suspected abuse of our probes can be reported at canary9.com/abuse.
Plans and billing
Paid plans are billed by subscription through Stripe and renew automatically until cancelled. You can change or cancel your plan at any time from the billing page; changes take effect at the end of the current billing period. Prices may change with at least 30 days' notice before your next renewal. If a payment fails and remains unpaid, we may downgrade or suspend the account after notice.
The service
We work hard to keep Canary9 reliable, and Enterprise plans include a contractual SLA. For all other plans the service is provided without an availability guarantee. Monitoring is a detection tool: it reduces the chance an outage goes unnoticed, but we cannot guarantee that every incident on your systems will be detected or alerted on.
Your data
Your monitoring configuration and check results belong to you. You grant us the rights needed to store and process them to provide the service, as described in our Privacy Policy. We may use aggregated, de-identified operational data to improve the service.
Intellectual property
Canary9, including its software, design, and branding, remains the property of Canary Monitoring, Inc. These terms do not grant you any rights to it beyond using the service.
Termination
You may close your account at any time. We may terminate or suspend an account that materially breaches these terms, and we will tell you why unless the law prevents it. On closure, your data is handled as described in the Privacy Policy.
Disclaimers and liability
The service is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by law, Canary Monitoring, Inc. is not liable for indirect, incidental, special, or consequential damages, or for losses arising from incidents on your systems that the service did not detect. Our total liability under these terms is limited to the amounts you paid us in the 12 months before the claim arose.
Changes to these terms
We may update these terms as the service evolves. For material changes we will notify account holders by email at least 14 days before the change takes effect. Continuing to use the service after that date means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Delaware, United States, excluding its conflict-of-law rules, and disputes will be resolved in the state or federal courts located in Delaware.
